My friend was in the process of acquiring a loan on her home to make improvements on it. I told her I could start a remodel a few weeks before as long as she took care of my essential needs and that I didn't mind working poor for a little while. I asked to be paid $150 a week about a month into the job. I asked her to sell her broken down second car (she has a late model, reliable VW as her daily driver). She is unwilling to do either. As of the 9th of December I have received a little under $4000. The majority of that has been used to buy job related items. I have completed 70% + of the job. She has helped me get food, a few items of clothing at a thrift store, tobacco and alcohol. That's part of the almost 4k I have received. I have no insurance, registration, inspection along with many other things. I have a cyst in my right armpit and when I told her I might need $200 to have it removed so I could move my arm without pain while working she balked. I have had to ask her for almost everything I buy and she has to be there to pay. I have never really known what is available as far as cash or credit. She told me she would get me $150 a week from a relative because I was complaining about not being paid. That has not happened. The total for the job was a "friend" price of 21600 to remodel 960 sq ft. In my view and that of a mutual friend, she seems to have very little interest in paying me. Here is the embarrassing part; I never had her sign a contract. However I have numerous texts, a friend who has talked with her at length about the details of our arrangement and work that is completed. Am I screwed?
You should consider preparing a letter to mail by certified mail, return receipt requested, to your customer to set out the facts and to demand the relief that you want. Attach your outstanding invoice(s) and photographs of your completed but unpaid work. Make sure that your letter is professional and business like as it may be evidence later.
If need be, consider filing suit in small claims court (assuming that your claim is less than $20,000), using your letter as evidence.
