I am a Contractor working on a commercial project. We are having issues getting payment and I am going to be filing a Mechanics Lien by the end of the month. The Client has reached out and said that we should have a check for a portion of the amount due by the first week of next month. If I file the mechanics lien for the total amount we are owed and they pay us a portion of the amount due, can I release part of the lien? or what should we do?
You can file what is called a "partial satisfaction of lien" satisfying your lien only to the extent of the payment. You should have an attorney review or prepare this document for you to make sure it is done correctly and does not compromise your remaining lien.
