Claim against construction bond.

CaliforniaBond Claims

I submitted a claim against a general contractor's Surety Bond for defective work. I provided before and after photos to prove that the work was being performed with the contractors bond was active. The Surety Bond company said that the date / time stamped photos do NOT prove the contractor was working in my home on those dates which coincide with the active bond period. I always thought a picture was worth a thousand words especially when its date and time stamped by an independent source (cell phone company, google etc.) After providing the contract, copies of cancelled checks, photo documentation and a written statement, the Surety company (Surtec) is still denying my claim. Can anyone help me out here?

It's common for a surety to do whatever they can to avoid paying out a claim. And, unfortunately, it will sometimes take hiring a construction attorney to force them to take you seriously. If you have any documentation which proves they were on-site at a specific date range - like a contract, purchase order, etc. - that could be useful. Additionally, if you provided digital photos, the metadata on those photos should be able to prove when the before and after photos were taken - proving the contractor was on your job on certain dates. This article provides more insight on that front: How to determine when a photo was shot. Still - consulting a California construction lawyer could be useful in forcing a surety to pay out.
