FloridaConstruction Contract

Hello, good afternoon. I have puschased a house to be built in Parrish FL and it has been delays after delays. The worst part is that the contractor has been working on the houses next to mine, causing my to be really delayed at this point the foundation is not even ready where other houses have their walls up. When I asked the sale representative he said legally they have 2 years to complete the house without being penalized. Is this true? Thank you ASP.

That’s only partly true. The two years is a requirement of the Interstate Land Sales Act. That doesn’t mean your contract doesn’t include an implied obligation to perform within a reasonable time, less than two years. However there may be other language in your contract that describes the contractor’s rights and obligations.
