CONTRACTOR NOT PAYING

Florida

Hi, I am cabinet maker working independently. I was contracted by company to do a vanity wroth $2300. completed the job but in the mean time the contractor and owner got into a dispute. The owner initially said that I would receive payment from her directly. Contractor said it was fine but because of the dispute, no one wants to paid. Owner now claims I should get payment from contractor, and contractor says he wasn't fully paid. I learned about notice to owner after the fact but I still sent the notice to owner November 18, 2021. (job was finished Nov 4).

If your notice was not received by the owner within 45 days of the first of you starting work or putting materials on the site then you have no lien rights. Nevertheless, the contractor owes the money to you whether he got paid or not. (I am assuming that you did not have a written agreement with the GC that you would be paid only if he got paid).

Yes, notice to owner was sent after completion of job. Yes, no contract with GC stating paid only if paid. Where to next? Any options to get paid?

Yes. You have the right to file a small claims lawsuit in the county where you live. You don't have to have a lawyer. If you go to the courthouse the clerk of the court will give you the papers to fill out with information about how to proceed. There is a filing fee and a fee to the sheriff to serve the court's summons and a copy of your statement of claim.
