Hi, Can I file a mechanics lien on a property if I didn't start installing my equipment? I ordered all the furniture after they gave me deposit, and now they just dropped me. nyc Thanks

It all depends on what you mean by "equipment". If you're referencing specially manufactured goods that will ultimately be installed as a permanent fixture in the property, then the answer is yes. However, you also use the word furniture. Furniture and other temporary items, even if custom made, are not able to serve as the basis for a mechanics lien as a matter of law. Accordingly, if that is the case then your remedy would be to sue for breach of contract because you would not have any lien rights.

If you ordered specially manufacturered material for the job, you may lien. if you are able to return the material please to. if there are restocking charges and other expenses, you may lien. If you cannot return, you may lien for the full order. if you have more questions, please send another inquiry, thi s can be complicated
