Question about a notice of completion.

I received a notice of completion for our project 21-358. The project completed on 11/19/21. Our Portion of the project was complete on 8/20/21. We have still not been paid. They have a Net 60-90 day pay term. I would like to send an intent to Lien but my timeframe has passed, is this still possible?

You can send an intent to lien, or just lien the project. You still have time to do so, as long as you served a 20-day prelim., because as a subcontractor you have 30 days from recordation of a Notice of Completion (NOC) to record a lien, or 90 days after completion of the project (not just your scope of work, but the entire work of improvement) if no NOC is recorded. Assuming no NOC was recorded and the project was completed on 11/19/21, you have until 90 days after 11/19 (around mid-February) to record. Call me if you would like to discuss.
