In Virginia there are 3 deadlines that are important to remember, preliminary notice deadlines, mechanic liens deadlines, and enforcement deadlines. Specifically pertaining to notice, on residential projects a 30 day preliminary notice is required. On other projects to make owner or general personally liable, notice should not be made later than 30 days after the completion of the entire work. In Virginia, a lien must be filed within 90 days from the last day of the month in which labor or materials were furnished and within 90 days from the time the work is completed.
General Contractors are required to file certification that a copy of the lien was sent to the owner along with the lien claim. Subcontractors must send the first page of the lien claim "Notice to Owner" to the property owner at the time of filing.
