The Notice of Commencement form is set forth by Florida statute § 713.13. That section requires that a Notice of Commencement be signed by the "Owner or Owner’s Authorized Officer / Director / Partner / Manager), and include the signatory's title or office. This must be signed, acknowledged, and verified before a notary public, who must also sign the document.
If there is an additional space to identify the party preparing the notice, that information can be provided. Since an NOC can be filed by an owner's agent, it can be completed by a party other than the owner (for example, it is not uncommon for a GC to be tasked with filling out and getting an NOC filed). The prepared by space would therefore be used to inform parties who provided the information for the notice. This is not specifically required by the statutory section setting forth the signature block requirements, however. According to statute, the signature block on a Florida NOC should have the following:
