The Notice of Commencement form is set forth by Florida statute § 713.13. That section requires that a Notice of Commencement be signed by the "Owner or Owner’s Authorized Officer / Director / Partner / Manager), and include the signatory's title or office. This must be signed, acknowledged, and verified before a notary public, who must also sign the document. If there is an additional space to identify the party preparing the notice, that information can be provided. Since an NOC can be filed by an owner's agent, it can be completed by a party other than the owner (for example, it is not uncommon for a GC to be tasked with filling out and getting an NOC filed). The prepared by space would therefore be used to inform parties who provided the information for the notice. This is not specifically required by the statutory section setting forth the signature block requirements, however. According to statute, the signature block on a Florida NOC should have the following: "(Signature of Owner or Owner’s Authorized Officer/Director/Partner/Manager) (Signatory’s Title/Office) The foregoing instrument was acknowledged before me this _____ day of __________, (year) , by (name of person) as (type of authority, … e.g. officer, trustee, attorney in fact) for (name of party on behalf of whom instrument was executed) . (Signature of Notary Public–State of Florida) (Print, Type, or Stamp Commissioned Name of Notary Public) Personally Known _____ OR Produced Identification _____ Type of Identification Produced_______________ Verification pursuant to Section 92.525, Florida Statutes. Under penalties of perjury, I declare that I have read the foregoing and that the facts stated in it are true to the best of my knowledge and belief. (Signature of Natural Person Signing Above)"
