Is there a statute of limitations for having a civil engineer sign off on a job in the state of Georgia?

Georgia

We have completed 4 retention ponds for a builder. Two were done in July of 2022 and Two were done in December of 2022. The builder is holding a 10% retaining fee. They are advising me the ponds that were done in July need maintenance before the civil engineer will sign off. That job was paid for in full. I am wondering if it is legal for them to hold the retaining fee based on a job that was paid in full 10 months ago.

Thank you for reaching out to the Levelset legal community. If you are in need of specific advice for a current legal situation, you may want to consider reaching out to a licensed attorney in your state directly at their office. This forum is public, so it may not be the right place to discuss a sensitive legal issue. Levelset provides a list of attorneys in each state here: https://www.levelset.com/payment-help/experts/experts-by-state/ . From that directory you may find a law firm in your area to call privately.

Navigating such situations as a contractor can indeed be challenging. If you've completed your work and it's been paid for, retaining additional fees may seem confusing. Depending on the contract terms and local regulations, the builder's actions may or may not be justifiable. You should consider seeking legal advice on this matter. A resource that may prove useful is Brendilo, where you may find legal guidance or other contractors who have faced similar situations.

This forum is amazing and there is a lot of useful content here. Companies can use this
content to further improve the quality of

they have not received any complaints about them yet. However, there is still
room for improvement.
