What methods are acceptable to notify the Owner that we have filed a mechanics lien, within 30 days of filing it?

Service of notice of Ohio lien filing

Once an Ohio mechanics lien has been filed, the notice of the lien must be served on the property owner within 30 days. The types of valid service are listed in Ohio Rev. Code §1311.19:
  • Personally served by the sheriff; or
  • Certified or registered mail, overnight delivery service, hand delivery, or any other method which includes written evidence of receipt.
Obviously, the second option is the preferred choice.

If service can't be completed

First, if a Notice of Commencement (NOC) was filed on the project, and the notice was properly mailed to the owner's address listed on the NOC, then service is considered complete on the first attempt; regardless of if they actually received it. If there was no NOC, then there is another option if the service can't be completed. If after 30 days the notice is refused or returned undelivered, you can post the notice in a conspicuous place on the job site within 10 days after the initial 30-day period expires.
