Once a New York mechanics lien has been filed, it will only be valid for a period of one year from the date the claim was recorded. If no action to enforce or an extension isn't filed, the claim will expire and not longer be enforceable.
If the client is being unresponsive, it may be time to consider filing a foreclosure action to enforce your claim. However, before filing your lawsuit, you may want to consider sending a Notice of Intent to Foreclose stating that if payment isn't forthcoming in x amount of days that you are ready and willing to foreclose on your claim. This notice is optional, but fairly effective at inducing payment. If not, then you should get in touch with a local attorney.
