During a time when I was having to make near daily trips to an area nearby, Rosemary Ami, hired me to wrap, pack, and stack, items left by her deceased sister Katherine Price, at 1090 Buckskin Dr., Show Low, Az.,85901. She was paying me $15 per hour. Gave me the keys, and packing materials, and told me to keep track of my time, this was in Nov. 2018. She also mentioned at that time she needed to get someone in there as she realized that just to spend an hour or so wasn't making the job go as quickly as needed. I'd had to repair a number of things just to make the place liveable. I then moved into the site to get things done quicker. That was March 1, 2019. In mid April,2019, I gave her a copy of my hours, which both the original and the copy had been signed by her. Come May,2019, I'd asked her when she thought she might be able to start paying me. That's when she exclaimed "I haven't any money!" At which point she decided to get herself out of paying me, she'd start charging me rent. Her keys were returned to her the end of May,2019. I told her I'd moved out as she was to be paying me for the work done. A judgement was obtained 11-14-19, in which the total awarded is: $3,500.00 plus 5.75% per annum. Rosemary didn't start paying anything until Feb.,2020. These amounts were only $40.00 per month. I text sent her a receipt and balance due which included the 5.75%. After making the second two month payment, she stated that if I continued to charge her interest, she'd not make another payment. The March and April payment wasn't made until May. Interest again applied. She then stated she'd not make another payment. Rosemary Ami is collecting Soc.Sec. and is a licensed massage therapist, having two locations she gives treatments: Snowflake, and Holbrook, as well as in peoples homes. She is yet paying on a mortgage on the home she lives in: 8476 Pueblo Ln., Snowflake, Az.,85937. She and I believe her brother were left the: 1090 Buckskin Dr., Show Low, Az.,85901,address. She also owns a mobile home in a trailer park, in Holbrook, Az. On the Show Low parcel, being said there are several liens. She's supposedly a man there, doing work on a place that hasn't an updated septic system. It only had a what seemed to be a barrel with a 2" pipe coming out of the top. Which was spewing sewage every time the toilet was flushed. I've photos of what I was asked by Rosemary to be cleaning up. I had to spend weeks cleaning the place, just to put a bed in it. We are a commercial general contractor in AZ. We recently completed work on (and were paid by owner for) a project that we had filed a prelim notice for with no issues . Last month an amendment to the original contract was created and executed for a completely new scope of work on the building next to the main building that we just completed construction on. It's really like a completely separate project, with a different address and completely separate set of financials. My understanding is that the reason an addendum was done, as opposed to a new contract, was that the owner preferred this for administrative reasons. With work now commencing on this new project, I need to protect this job. Can I file a new prelim based on just the dollar amount on the amendment? Or am I required to file an amended prelim to the original since addendum is tied to the original contract? If the latter, is there any way around this? The owner may run into issues with their lender if we have to file the amended one. ...Read More
The home had major fire damage. I was sub contracted by the GC to provide and install new wood flooring. The main level of the home has both plywood and concrete subfloors. The plywood subfloor was was not level and showed sagging in areas that may have had water from the firemen pooling. We did the best we could to level the floor but it still was not right. I don't know if the plans called for the floor joists to be replaced or not. We informed the GC multiple times about the situation but because of scheduling pressure with other subs we all decided together to proceed with the install. The GC argued with us about the subfloor problems. Now the Homeowner has moved in and is complaining about the new wood floor not being level and wants it pulled up and re-done. We had a mold inspection conducted by a licensed engineer. It came back as toxic mold. Our landlord stated he was hiring ServPro to complete the repairs and restoration. Two gentlemen showed up with a truck clearly marked “Not a Licensed Contractor.” They are currently cutting through walls and claim the repair is a “walk in the park.” They seem very vague with their explanations, and he continuously repeats himself, stating, “I want to have to do more work to get paid more. I’m not on the landlord’s side.” We never mentioned any form of bias, yet he has reassured us over 10 times that he isn’t biased. I'm a subcontractor working on a new commercial construction project for a General Contractor. We have a contract and some change orders are on GC letterhead that we have signed. However, they have not fully signed. Some of the fully unsigned change orders have been added to Textura and we've invoiced and been paid. Currently there are significant differences between our outstanding Add service change order and the GC's deductive change orders. Neither of the disputed change orders have been signed. However, we're in agreement on some of the deductive change orders but not all of them or the amounts. At this point we are moving forward with a lien, but unsure of the amount we should lien for. IN AZ. I was hired by a subcontractor (who has a contract with the GC) . I do not have a contract with the GC, but am in process of filing a lien due to $50,000+ of underground utility work completed. The general contractor is trying to dispute saying: Dispute - No contract existed between owner or GC and sub sub (us). Since we entered into a contract with a sub-contractor that did not have the authority to hire us. Although the GC was aware we were on property and made us attend a mandatory meeting agreeing to pay us. 2 months later no payment. Do we continue with the lien process?
