The contract was signed, but are there other courses of action, such as filing a lawsuit against the property owner(such as unjust enrichment)? Also is there a responsibility on the part of the GC who is claiming not to have been paid. Do they have the responsibility to verify they have not been paid, and also to diligently attempt to pursue the payment through legal means? I checked in the jurisdiction and no court case or liens have been filed by the GC....Read More

We are filing a Small Claims lawsuit against a non paying customer here in CT. I wanted to get clarification on where the filing needs to occur. CT guidelines are: "If the plaintiff is a person and not a business and the case does not involve a landlord-tenant matter, the place where the hearing (trial) will take place (venue), if a hearing is necessary, will be a court in one of the following places: (1) where you live; (2) where the party you are suing (the defendant) lives or does business; or (3) where the thing or injury you are suing about took place. If the claim is a landlord-tenant matter, the trial will be in the court location where the house or apartment (premises) is located." Can we file in the jurisdiction where we live, or must we file where the defendant lives which is also where the project was completed? Thank you....Read More

We sold a load of Plywood to Selected Furniture LLC in Knox, Indiana (invoice date: 8-5-2021). They made some partial payments, but stopped after the last payment on 11/07/2022 ($1,000). The remaining balance is $9,372.39. Silvaris Corporation pursued collections through small claims court in Starke County for $6,000 (small claims limit when filing without legal representation). We received a summary judgment ($6,125 with court costs) which has been signed by the judge. I lived with a woman who was the caregiver for an older man and remodeled the joke we shared for over two years at my own expense. After adding 400 Sq. Ft of new living space that added 40,000$ to the value of the property the woman got a quit claim deed and refinanced. When she did this she had the man evict me with a three day notice. When they evicted me I wasn't home and within two hours all of my belongings were stolen leaving me without not only My life's possessions but over 30,000$ in construction tools were gone. They won't pay for the 12,000$ in receipts I have and I haven't been able to take them to court for wrongful eviction because I'm staying with friends and totally broke. I was working a residential bathroom remodel, the contract was for 22627.01, including tile cost when selected and with change orders and additional work, verified through emails and verbal change orders the total became 27752.78, I was paid intermittently total of 13000. when it came to 1 more day of work to just knock out a very small punchlist, the night before I asked for 10000 and allowed him to hold a retainer of 4752.78 until the next day when i completed the job and he was happy. He denied the 10000, wrote a check for 2000. then the next day, I was told that I was not allowed back to the property and that my workmanship was unsatisfactory. Then he offered 2900 only if i signed a letter of dissolution. Hes now threatening to file fraud with L and I. all the supposed poor workmanship was the things I had on my punchlist, The bathroom is absolutely beautiful, Ive showed pictures to alot of people and everyone agrees that its a great bathroom and the amount of work I put into it is close to 300 hours. Throughout the process, there was never a single complaint and his wife even said multiple times that with my work skill and knowledge of processes and supplies I should have my own improvement show or broadcast on youtube. But the day before it was time to settle up, my work all of a sudden was unsatisfactory. pictures are up on my website. www.waunatile.com under a.d.a. compliant remodel. this guy owes me almost 13000 and all my prices are completely justified, hes making up prices for my business, what do I do, I have 400 to my name as all I had went into this project....Read More
