I am a subcontractor that performs work for a commercial project. Unfortunately, the general contractor cut back on my billing for what is now due and paid a portion to my supplier for this month's invoice. In addition, the remaining funds owed to me were used for a future invoice that is not due yet or billed for.
TexasAn IT Network consultant is the Owner’s design professional for the IT portion of a design project. They are responsible for the design and oversight of that portion of the project. They are not licensed architects. The IT contractor has submitted a G702 with G703 for payment. The forms appear to be properly filled out. Legally, can the IT consultant sign on the architect certification line?
TexasWe are a supplier on a commercial project in TX. We created a custom ceiling for the developer/owner. Typically we ship FOB factory, with title passing at time of shipment. Occasionally, when customers are not ready to receive the goods, they will have us store them temporarily. In this case, the customer asked us to store the completed goods. We consider that title passed when we put the goods into storage, so we issued the invoice. Does TX agree with that? Can we send the preliminary notice though we still have physical possession of the specially-made goods?
TexasWe missed the deadlines to be able to file a claim on the prime contractor's bond, but is there still a way that we can get the payment owed to us by the second tier subcontractor?
TexasI'm an independent contractor who was hired by the tenant of a new restaurant in a strip shopping center. I performed many services for the tenant such as HVAC changes, masonry work, and painting. I supplied some of the materials as per the Tenants request (paint and supplies). I worked during the month of November 2022. My last day of work was 11/28/2022. Payment for the work was due on my last day of work which was 11/28/2022. The tenant is refusing to pay me for my work and material cost. The tenant paid the first $1000 on 11/16/2022 and is refusing to pay me the balance owed of $2500. I do not have a written contract with the tenant, however I do have an oral agreement with the tenant. I sent out a Notice to File a Lien to the tenant and property manager on Dec. 2, 2022. Do I have the right to file a Lien Affidavit? All work was performed in Texas.
TexasThrough levelset I filed a lien on a residential property. It was approved through the state of Texas and now the homeowner is suing me for claiming false lien filed. What can I do as I believe I had every right to file

TexasHi, We are a firm that specializes in helping landowners/developers develop special districts (MUD, PID, TIRZ) for funding infrastructure in master-planned communities. We have never been clear on if we are able to file a mechanic's lien for our services, can you please give some feedback? I am also interested in the constitutional lien in Texas, as we have a contract directly with the landowner (developer) and I was thinking this would be our route?
