Performed 3 weeks of labor sanding the wood floors in a home. When time came to stain and finish the floor, the customer became too difficult to work with (couldn't pick a color, didn't want to use the products we normally used, wanted me to use their products against manufacturer specifications, and then walked all over our prepped floor with dirty shoes setting us back another couple days)so in frustration I told him to just find someone else to do the stain/finish since he didn't want it done the way we do it and he could just pay us for the sanding. I am an ongoing subcontractor in Ohio. Our client has been paying us for over a year. They have now started to default on payments. We have not field a Notice of commencement as the type of work we provide is billed by the time and not the project. Some of the work was in assistance with their production as a refinery and some was in building up their facility (real property). They have acknowledged the they owe the moneys due. Probably not a question you can answer, but we had a contractor take material from a job site, and use it on another job, that he was not authorized to use it on. Then he started buying product for the new job, and we would like to file a notice of furnishings on it. We are well within the 21 days to file the notice on the product that was properly purchased and shipped to the new job, but past the 21 day on the product he used that he was not authorized to ship to the new job (he bought it under the old job's P.O. and had it shipped to the old job). We would like to cover that very expensive product that is beyond 21 days.... Should I file a notice going back beyond 21 day to the point when we have now discovered the product was moved from one job to the other, or should I file it within the 21 days, and include the unauthorized product?
