So we paid off the lein to the county clerk and the subcontractor had one year to bring a law suit. The sub contractor never sued since he had no mean of winning. We hired a roofing contractor to install insulation, replace new plywood sheathing and new asphalt shingles. There were the following six total suppliers and subcontractors on the project: a) Insulation and plywood sheathing supplier b) Shingle Supplier c) Gutter Contractor d) Electrician (since they accidently cut some wires in the attic) e) Dumpster Service f) Portable Toilet Service The roofing contractor is only providing me with 4 lien releases (a, b, c, and d). The contractor is saying that in WA State only vendors/contractors that provide more that $1000 in goods or services need to provide a lien release. Is this true? We have had the dumpster sitting on our driveway for over 1.5 month and they have had to switch out the dumpster 3 times so I'm worried that this might be a huge bill. Also, with the portable toilet (honey bucket), it has been sitting on our driveway for over 1.5 months as well. I have called WA State L&I and they suggest I get the roofing contractor to provide signed lien release on all supplier and subcontractors. When I asked the roofer a second time, he again stated that only vendors and suppliers over $1,000 is required to provide lien release. What do I do now to protect myself? Is he correct? I am a residential homeowner in Texas. My wife and I are contracted through a custom home builder to build our plan. We have continually paid him when draw requested initially after the job was completed, then during progress and lastly before work was even performed. The last several draws have pulled us into a heated dispute concerning quality of work or timelines for completion. Recently, we were notified of a subcontractor filing a lien against us from a draw we paid to him 3 months prior and another 2 additional subs discovered by us still unpaid. After confrontation, a month ago, he now says all bills are up to date. He won't provide paid receipts or invoices for proof and we have nothing in the contract that forces him to. He has slandered us with the subs and they will not discuss details with us to ensure our financial future. How do we keep from paying twice or additional charges from contractors he has failed to pay up to date? Can we make him provide lien waivers from these subs under Texas law now after time has passed? The contract does state all subs will be paid by him although, there is no timeframe listed unlike what's found in the Texas Prompt Payment Act? Where do we go from here so that it will not happen?...Read More

i am an unpaid sub on a job. Freedom Mortgage is holding a final draw on the property. i could not get homeowner to agree to pay me so i filed. now that i filed, we have agreed to paying me out of the final draw from the bank. The bank however wants me to record the NJ release of unpaid balance form BEFORE the money can be distributed to the GC/Homeowner.
