We performed work on a job that recently filed a NOC. We have not been paid in full on the work performed. We were hired directly by the owner. We filed a prelim notice when the job started, however, upon some recent research, we found that the owner refinanced there lending mid project. Therefore, we are in the mist of filing a stop payment notice, however, because our prelim was filed with the original lender, this is who would receive the stop payment. How do we proceed with something like this? Do we update our stop payment notice to note the new lender? Even though we did not send a prelim to them. I made a verbal contract what's a contractor to do some updates to my home and pay pay him a weekly $1000. Something always came up where he couldn't work one reason or another but he always showed up for his pay and promised to be back and work the entire weekend which I would agree to because he worked a full-time job during the day Monday through Friday. I have ended up paying him $3,900 for work that was never completed. I have finally told him not to come back and that I was going to pursue both legal action by lawsuit and sheriff's because I've had a lot of items come up stolen. I then made a post on Facebook about how I was finally standing up for myself and not letting people push me around anymore cuz I do have a horrible time about standing up for myself and saying no and had told the contractor to bugger off and I would scream it from the rat rooftops that they were no longer allowed to take advantage of me to which he even responded this morning saying I was a gang banger that I need to get on my meds that he was bringing the cops to me cuz he's left a couple of tools here I need to know what my legal options are cuz he has not done anything but spackle the same area over and over again my house has been in a state of chaos since March 10th....Read More

I am a Subcontractor who is not getting paid. I sent a demand letter to my customer and I received a letter from an attorney stating they filed a notice of completion and we do not have lien rights because we did not file the lien within the time frame. If we are still working after a Notice of Completion is filed, are lien rights extended? It's contract work that doesn't affect the ability to occupy the building so the NOC was filed because there was a date it needed to be filed by for loan purposes. Temp CO has been issued as well. Do we have the same 30 days to file the lien as everyone else?...Read More

Our company provided construction labor and some construction supplies on a project in bountiful Utah. It was a cost plus agreement. We started the project in June, were paid timely for our first invoice, July paid timely for our second invoice. Came back in October after the custom material had been delivered under the same agreement. Once our last invoice was sent, the property owner contested the invoice and only paid about 30% and has since been very difficult to get an answer from as to his intentions on paying. Our company in based out of Idaho. The last date that we worked on the property was on October 24th, 2019. Are we still within our lien rights for Utah? We have made weekly attempts to communicate. For the last four weeks the property owner is seeming to stall, giving no real answers as to his intentions. What would you suggest? Thanks ...Read More

I am trying to determine when "the work" ends on a job. For example, we did a fire job that required us to be in the home cleaning the structure and cleaning their content. That part of "the work" (physical, actual work) ended a month ago. But we are now dealing with paper work, insurance companies, broken or lost items, damaged items, etc, all of which is "work" but not on the property and the actual "work" per se. But does this post "work" work also count towards the work to be performed for the entire job? In other words, as we are going through all this administrative work, is the project still active and ongoing such that my 90 day clock to file a lien has not started yet? Or does the clock start when we walk off the job even though we have many days of administrative work to do in order to truly close the job?...Read More

The owner has told us there is a newer law he was made aware of that says we have to notify the sub contractors by certified mail. In the past we have simply emailed the notification. 1) Is this true? 2) Do we need to notify sub contractors and/or their suppliers if we already have a signed Unconditonal Upon Final Waiver from them? A local business hired a main contractor to do a remodel who then subbed it out to another guy who then had my boyfriend finish the job as his "employee", as my bf doesn't have his own licence yet. I know for a fact that the main contractor was paid in full for the job and supposedly still hasn't paid the subcontractor that hired my boyfriend so therefore my boyfriend hasn't been paid and the verbal agreement was for about seven Grand.
