I provided a Retainage Bond to a GC on a HUD project and the GC is stating that since the retainage is being held by the owner and not the contractor it will not be released until completion. I was under the impression the bond worked weather the project was HUD, Government or Private. Any advice on this? Or RCW's I can refer to?...Read More

Hello, I live in Colorado and I have a question regarding the new Retainage law HB 21-1167. I work in construction and have multiple projects. We have a lot of schools and Hospitals. The new law was just brought to my attention by another General Contractor. I would like to know if the contract was written after the law passed and the General Contractor listed 10% withholding are we held to that 10% because it is in the executed contract or does the Retention limits in the new law override the contract?...Read More

I have a public project, not with TxDOT nor wholesale water supply, with work valued under $400,000. Reading the FAQs, there is a statement that the Texas public retainage laws apply to projects valued more than $400,000. However, the very next answer states that the retainage applies on public work contracts valued at less than $5M and that the retainage cannot be more than 10-percent. Please clarify. In North Carolina, the statues state if I have no employees (or less then 3 to be technical), I do not have to carry WC. Now, at the time of being hired and on the job, I did have WC, as this GC claims his insurance company requires it. I keep trying to explain the law to him and that I do not. I finished the job, and while waiting 2 almost 3 months for everyone else to get done and pass inspections, the policy has now expired. He claims I need a new policy put in place just for them to write the check because their insurance company will audit them and it has to be there that day. I said no, it has to be there while I am on the job, not when you finally get around to writing checks. I do not plan to work for this client any longer and do not need to spend $1,000+ dollars just for them to mail out a check according to the law as I know it. Is there something I am missing? Or is there a way to make him send it? Lein the job? Have a lawyer send a letter demanding he is illegally withholding the moneys? What can I do other then wasting $1,000 to get 2?...Read More

I was recently told that Home Improvement Contractors (i.e., kitchen remodel) are not allowed to provide a Time & Materials contract - that the contract must be a set price and any changes to the scope of work/price must be covered with a Change Order. I have a question regarding the Prime's delay in submitting a subcontractor's invoices to a vendor for payment. My business provided work for a Prime contractor. They are now rejecting invoices that are over 1 year old, even though we submitted these invoices in a timely fashion. Is there any requirement for a Prime to submit all invoices for service provided within a certain time frame? Or can a Prime hold onto a subcontractor's invoices, without submitting them to the state, for an indefinite period of time? TIA...Read More
