The lender already has acknowledge receipt of the property being surrendered and has the keys to the property. Am I responsible for paying the lot rent when I have notified the mobile park that I am no longer responsible for the mobile home? The mobile home has contacted the lender.
GeorgiaI made deal with roofer through emails. May 7th I attached USAA statement that stated my high deductible and $3541.18 insurance check amount and to send them final invoice once work is complete. In that email i stated my deductible is way higher than I expected. We finally came to deal I pay $2k from my next pay check which I have paid him. Then when I get the $3541.18 insurance check I'll send that to him but I can't afford anymore I don't have extra cash. I got email today $15k lien on my house after USAA told him they won't pay him anymore his quote was less than there's. Am I liable for all that or what I agreed to with him in my emails total of $5541.18? I originally was willing to pay him more even though I told him u agreed to this deal. What's my rights here? Plus his spelling of my street is wrong and he has wrong names on his lien compared to the deed.

GeorgiaIn Georgia, when does the commencement of work actually begin?
GeorgiaThis is the scenario:
There is our company that installs racks.
There is our CLIENT-A that also installs racks but hired us to do it.
There is his client that hired him to install the racks.
We worked. Our job was completed over 2 weeks ago. Our client doesn't want to pay.
He won't answer e-mails, phone calls or text messages from our recruiters or admins.
Sometimes he answers and if he hears our voice he hangs up.
I have another client - we will call it CLIENT-B, they recommended CLIENT-A to us but at some point they had a similar issue, and they also had to file a lien on them too. They recommended this page to me because the way she explained it was that the lien went on his client which is a big deal because he does not want to get in trouble with his own clients.
What are our options?

GeorgiaThe gear we bought on the job is bought and paid for, job is now delayed because the panel cans will not all fit in the electrical room.
1/2 of it (the 1/2 onsite) was billed for under the stored material line on our schedule of values.
The material onsite is the same material that wont fit.
This is important because i specifically excluded re-design in my contract.
However the GC blames because he states "your submittals were never approved in writing" .
Submitals sent in 6 months prior

my work was damaged by another sub, i had to go back and re-do my work underneath a parking deck- aprox. $15,000
Before going forward i sent an email to the GC explaining the situation , and asked him to proceed, he said "yes just send me the rates"
Now he is unwilling to pay until the sub who damaged me accepts the damages (which they probably wont)
is this lienable?
GeorgiaOver the Fall and Winter of 2017, personnel from our company has been to the customer's house to (1) meet Allstate adjusters to negotiate a more lucrative claim settlement for the insured (2) met with different subcontractors to establish an accurate scope of work for the multiple trades within the claim (3) accompanied a carpentry subcontractor at the property to remove a shutter from the house so they could bring and keep it in their shop for precise measurements. We performed all those functions at the customer's house in addition to a myriad of communication with Allstate's claims department from our office to assure the customer received maximum benefits. After the customer received all the benefits from our efforts, she is now not cooperating with us and has shut down all communication. We would like to place a lien on the house. The only physical work we've done to the house thus far is climb onto the roof with the adjuster on multiple occasions and accompany a subcontractor to remove a shutter from the house and take away. Could we legally put a lien on the house?

GeorgiaOn the Georgia lien waivers, there is language that says "WHEN YOU EXECUTE AND SUBMIT THIS DOCUMENT, YOU SHALL BE CONCLUSIVELY DEEMED TO HAVE BEEN PAID IN FULL THE AMOUNT STATED ABOVE, EVEN IF YOU HAVE NOT ACTUALLY RECEIVED SUCH PAYMENT, 60 DAYS AFTER THE DATE STATED ABOVE UNLESS YOU FILE EITHER AN AFFIDAVIT OF NONPAYMENT OR A CLAIM OF LIEN PRIOR TO THE EXPIRATION OF SUCH 60 DAY PERIOD." If we signed Interim Waivers and Release Upon Payment and we aren't paid, does that mean we need to file a lien for each progress waiver? What if the 60 days expire but my last furnishing date was less than 90 days ago so I'm still within my lien rights timeline?
GeorgiaIn order to get paid, contractor is requiring a release of lien, but do not want them to record it until we get paid so I want to put "draft" on it.
GeorgiaI am not sure if it is too late to file the lien.
Georgia60 days ago, we drew for 50% retention on a project that was closer to 80% done. They paid the material and labor draw but refused the retention draw saying they'd pay it all at the end. The contract is now 100% complete with no complaints.
Our contract does state they have 60 days for final retention. Do we not have the right to 50% upon 50% completion. Do they have the right to hold it?
