We are looking to file a claim for non-payment and want to know how our changing project roles affects bond claim rights. We started a public hospital job as a sub for a GC, but mid-project that GC got kicked off the job. We made an agreement with the property owner/public entity to finish the job for them. We are a subcontractor in Texas, hired by GC for a bonded job in Houston, Tx, the December bill has not been paid and missed the March 15th deadline. Is it to late to submit a notice? I also have a January invoice that has not been paid. My boss had me bill out the job 100%, plus CO's, and a separate invoice for retainage for March. Can I send a notice for all outstanding billing, or do I have to send a separate one for each month?...Read More

Yesterday I asked a question about how to go about trying to get money even though we did not file on the bonding company in time. Thank you for answering.. Now we did file notices on time and we should still be able to claim on the bond even though we did not file in time. So how would we got about doing this? Would we need to get a lawyer to send a letter to the surety company to enforce the claim? We are in Texas and this is a public job on a school. We were hired as the subcontractor....Read More

We are in Texas, a contractor threw us off a project and will not pay for any materials or labor for the months we worked. This has hurt our company tremendously. We filed notices on a project on time but because of being mislead with a zlien rep we did not file on the bond in time. So my question is, since we filed our notices on time and it got sent to the bonding company are we able to file or do anything to get our money? Would sending a demand letter from an attorney to bonding company help?...Read More
