New YorkI am the project manager for the property owner. We recently completed a project, and the General Contractor has been paid in full for the contract total and provided an unconditional lien waiver. However, one of their subcontractors reached out to me saying they had not been paid and that they were moving forward with filing a mechanic's lien against the property. Am I responsible for paying the subcontractor if the General Contractor did not fulfill their obligation?
New YorkI have a general contractor whose retainage payment was delayed because they refused to provide the closeout documentation outlined in their construction contract (documents that are appropriate for this phase of the project, such as conditional waivers, progress photos and proof of inspections). We were in constant communication and advised them that as soon as their obligations were satisfied, payment would be released. In the end, we called our losses on a few documents just so that we could get them paid and get the project wrapped up. Shortly after we made final payment, we get a notice from the county that the contractor had filed a mechanic's lien against our property. I have made numerous attempts to contact the contractor to request they file a lien release, but they are ghosting me. If they will not voluntarily file a release, what are my next steps?

New YorkI filed a mechanics lien on a mobile home, for a demo project that we did not receive payment for. The attorney of the owner of the trailer park has stated we have to remove the mechanics lien because the trailer does not constitute real property... is there another option for me? What should I file?
New York1. Can a NYS design/build company file a mechanic's lien only for the design portion of a project when the contract was for the design portion only? No construction labor was performed.
2. If the contract provided for an hourly fee and the design scope was not completed (i.e., the construction plan was not completed), is a mechanics lien for design hours expended appropriate?
3. What is the definition of "labor"?

New YorkWe are a specialty supplier/manufacturer of stainless steel pools and spas, and for a handful of our projects we are responsible for their onsite installation. I was wondering if I should use the first timecard from engineering department to design the pools/spas for this project as the first furnishing? Or should I use the first date payment was received by the customer, which occurred a few months later?
New YorkI am the project owner or a commercial renovation. We require lien waivers from our General Contractor and each of their subcontractors at the end of every project. During this particular project, our GC fired a subcontractor. They were paid through their termination date, and I have a conditional waiver for that payment. However, the subcontractor is telling me that he is still owed the full contract amount. The GC said they will not pay because the contractor didn't complete the work, and they incurred cost finding another subcontractor. Does this subcontractor have lien rights for the upaid amount, even though they did not complete the work?
